OUR CRAFT
The property developer takes the initiative in delivering the real estate operation intended for sale, arranges the insurance policies and secures the financing from its banking partners that is essential to the smooth running of the project. OUR GUARANTEES
THE FINANCIAL COMPLETION GUARANTEE (GFA)
Under French law, within the framework of the off-plan sale (VEFA), the GFA fulfils the obligation set out in Article L.261-1 et seq. of the French Construction and Housing Code (CCH). It gives the buyer the assurance that, should the developer default, the financing needed to complete the building is guaranteed. Since 1 January 2015, the law requires the developer to provide buyers with an extrinsic guarantee, backed by a third-party guarantor such as a bank or an insurer.
THE GUARANTEE OF PERFECT COMPLETION (GPA) — 1 year
The guarantee of perfect completion covers all defects and workmanship faults recorded on the handover report or arising during the year following the date of that report. Should such damage occur, the builder is required to carry out the repairs at its own expense.
THE TWO-YEAR GUARANTEE
The two-year guarantee is a warranty covering property construction, provided for by article 1792-3 of the French Civil Code. Also known as the guarantee of proper functioning, it covers defects affecting the correct operation of equipment elements that can be separated from the structure of the building — that is, that can be removed or replaced without damaging the construction (doors, windows, blinds, taps and fittings, heating, electrical systems, etc.).
THE TEN-YEAR GUARANTEE
The ten-year guarantee is the warranty owed by the builder, covering the repair of certain types of damage that may affect the construction for a period of 10 years from the handover of the works. The damage covered is that which compromises the structural soundness of the building and of the equipment elements that cannot be separated from the foundation, framing, utility, weatherproofing or roofing works without damaging the construction, as well as damage liable to render the building unfit for its intended purpose. Such damage may concern the roof, the framework, the walls, and so on.
